뉴욕시, 생체인식 데이터 보호법(biometric data protection law) 발표
- 해당 법안은 2018년 뉴욕 시의회에 도입
- 2020년 12월 생체 인식 데이터 사용과 그에 따른 정확성, 보안 및 개인정보 보호에 관현 보고서 발행
- 생체인식 데이터베이스는 보안 위반에 노출 쉬움 (기존 비밀번호와 달리, 생체인식 데이터는 쉽게 변경할 수 없음)
- 기업이 생체 인식 데이터 수집시, 통지를 요구하며, 해당 데이터의 거래를 금지
- 위반 건당 500-5000달러의 손해배상 징수 가능(사적 소송 권한)
적용 대상
- 상업시설에서 단독 혹은 조합하여 개인의 식별에 사용되는 생리학적 , 생물학적 특성(biometric data protection law)
- 상업시설(commercial establishment)에만 적용됨 (*정부기관제외)
